Terms & Acceptable Use

These terms govern your use of Merchant Signal, a product of Kingbird Solutions LLC. By creating an account or using the service you agree to them.
The service
Merchant Signal provides scored leads of newly opened and about-to-open businesses, compiled from public records, on a subscription basis. We grant you a non-exclusive, non-transferable right to use the data for your own outreach.
Data source and accuracy
Leads are derived from public records and other publicly available sources and are provided “as is.” We work to keep the data fresh and accurate but do not warrant that every record is complete, current, or error-free.
Your compliance obligations
You own your outreach. You are solely responsible for complying with all laws that apply to your calls, texts, and emails — including the TCPA, CAN-SPAM Act, the National Do-Not-Call Registry, and any state telemarketing rules. You agree to scrub against do-not-call lists where required and to honor opt-out requests.
Acceptable use
Do not resell or redistribute the data, use it for unlawful, harassing, or discriminatory purposes, or attempt to scrape, reverse engineer, or disrupt the service. Accounts are per the seats in your plan.
Subscriptions and billing
Paid plans bill monthly through Stripe and renew until canceled. You can cancel anytime; access continues through the end of the paid period. Fees are non-refundable except where required by law.
Disclaimers and liability
The service is provided without warranties of any kind. To the maximum extent permitted by law, Kingbird Solutions LLC is not liable for indirect or consequential damages, and our total liability is limited to the fees you paid in the prior three months.
Termination
We may suspend or end access for violations of these terms. You may stop using the service at any time.
Governing law
These terms are governed by the laws of the State of Arizona. We may update them and will revise the date above when we do.
